Reimagining the Future: Synergising Legal and Technological Innovations in Maritime Trade

The COVID-19 pandemic has caused a major disruption to global maritime trade, calling into question the reliance of physical transmission of paper documentation to operate supply chains. It kick-started the call for greater digitalisation and strengthening of the global trading network beyond the pandemic. While there are potential benefits to the digitalisation of the trading system such as greater efficiency and reduced costs and fraud, the lack of domestic legislative recognition of the Model Law on Electronic Transferable Records and difficulty in the harmonisation of electronic trade documentation standards could impede this transformation of maritime trade.

 

The panel discussion will address the legal and technological challenges of digitalising the maritime trade from a multijurisdictional perspective, with reference to the latest legal developments in the use of electronic trade documents, the proposed use of a neutral, freely-available and MLETR-compliant framework like TradeTrust, and how TradeTrust enables platforms and systems provide the technical foundation for digitalising maritime trade documentation at scale. The focus will be on exploring ways of synergising law and technology to propel the maritime trade industry in Singapore and beyond. By leveraging these advancements, legal professionals can be better positioned to serve their trade clients and contribute to the growth and efficiency of the maritime trade sector amidst this evolving landscape.

Daryll Ng

Qualified to practise both in Singapore and the UK, Daryll has appeared at all levels of the Singapore Court and has acted in numerous arbitrations and mediations. Jeffrey Lim

Jeffrey is a legal practitioner specializing in intellectual property, data protection, cybersecurity, data governance, and AI. He has worked with various organisations from global big tech to national organisations, in industries ranging from healthcare, financial services, e-commerce, consumer platforms. He has also advised foreign governments on data protection and security laws. Jeffrey also helped develop the Singapore Computer Society (SCS) AI Ethics Body of Knowledge (BOK) and is leading the review of the second edition of the BOK. He also helped establish the world’s first AI Ethics professional certification programme in collaboration with SCS and IMDA. 

 

Loh Sin Yong

As Director for TradeTrust at IMDA, Sin Yong is responsible for driving the digital transformation of Singapore’s trade and logistics sectors to help businesses maintain relevance and competitiveness by evolving ahead of the rapidly progressing digital economy. Sin Yong has over 30 years of professional IT and leadership experience in trade facilitation, logistics, maritime domains particularly in the China, South East Asia and South Asia markets. He represents Singapore as Head of Delegation at UNCEFACT and holds a Bachelor’s degree in Computer & Information Sciences, a Master’s degree in Management of Technology, and a Graduate Certificate in Intellectual Property Law. 

 

Loh Wai Yue

Loh Wai Yue is an experienced litigator specialising in the fields of shipping, international trade and marine insurance. He is part of a select group of senior practitioners at the Singapore Bar accredited by the SAL as a Senior Accredited Specialist in Maritime & Shipping law.  

 

Wai Yue is often ranked as a leading lawyer ranked various legal directories and is noted for being ‘brilliant in in the way he deals with complexities’, the lawyer who ‘understands the business practices and operations’, and a ‘strategist who can come up with detailed solutions’. Wai Yue is qualified to practise in three jurisdictions, namely Singapore, Hong Kong and England & Wales.

 

Wai Yue also brings to the team his previous experience of working as a defence lawyer in the largest international Group P & I Club, advising shipowners and charterers in relation to, amongst other things, the drafting, acceptance and enforcement of Letters of Indemnity.  

 

Wai Yue’s expertise spreads across contracts and disputes in relation to the trading of oil, dry bulk cargoes and trade finance. He is also a leading lawyer on charterparties, bills of lading, contracts for port services, unsafe port and cargo claims, and ship building/sale and purchase disputes. He is a regular speaker, both regionally and internationally, on topics relating to maritime law, international trade, commercial disputes and risk & compliance. 

 

Wai Yue is on the Panel of the International Arbitrators of the Shanghai International Arbitration Centre.  He also serves as a member of the Procedure Committee of the Singapore Chamber of Maritime Arbitration (SCMA). 

 

Mr Yeong Zee Kin 

Chief Executive, Singapore Academy of Law  

 

Zee Kin holds a Master of Laws from Queen Mary University of London and completed his undergraduate law degree at the National University of Singapore. His experience as a Technology, Media and Telecommunications lawyer spans both the private and public sectors. He has spoken and published in areas relating to electronic evidence and intellectual property, as well as legal issues relating to Blockchain and AI deployment.  

 

Zee Kin is an internationally recognized expert on AI ethics. He spearheaded the development of Singapore’s Model AI Governance Framework, which won the UNITU WSIS Prize in 2019. He is currently a member of the OECD Network of Experts on AI (ONE AI). In 2019, he was a member of the AI Group of Experts at the OECD (AIGO), which developed the OECD Principles on AI. These principles have been endorsed by the G20 in 2019. He was also an observer participant at the European Commission’s High-Level Expert Group on AI, which fulfilled its mandate in June 2020. 

 

Zee Kin is also a well-regarded expert on data privacy issues. He has contributed to publications on legal issues relating to data privacy, and has spoken at many well-recognised international and domestic platforms on this topic.
